The Facts About Legal Disputes

This section will list any contract and legal disputes that are in the public domain as well as any significant changes to a companies trading history from companies house.


As part of your Due Diligence process you may want to do a company and director search on all the directors and principals of the franchise or the company that owns/holds the master franchise rights.  This is free and can be done through Companies House here.


Be aware that a franchisor will endeavour to prevent disputes going to court and being published in the public domain.   Sadly, you'll find that many franchisees have exited with clauses preventing ANY disclosure, factual or otherwise.


You may wish to perform checks through the likes of LinkedIN and search the name of the franchise to find present and PAST franchisees.


Legal Considerations


You also need to consider that franchisors will have legal teams and deeper pockets than many franchisees that perhaps find themselves at the wrong end of a contract dispute.  Civil Legal cases are not always won on right or wrong, but by who has the best lawyer.


When cases are published that favour a franchisor - that may be the legal judgement, so be sure to look at the legal ARGUEMENT in more detail.


As part of your Due Diligence be sure to ask for the full company details that your franchise contract will be issued from as well as all directors, shareholders, persons with significant control, investors and principals.
